1. Agreement to these Terms

These Terms of Use ("Terms") govern your use of Slow Blink, a private archive for cats made by German Amaya ("German Amaya," "we," "us," or "our"). By downloading, accessing or using Slow Blink, you agree to these Terms and to the Slow Blink Privacy Policy. If you do not agree, do not use Slow Blink.

2. Slow Blink is not veterinary advice

This is the most important section of these Terms, so it comes first.

Slow Blink is a record-keeping tool. It stores what you enter about your cat and presents it back to you in an organized form. It does not diagnose, does not interpret symptoms, does not recommend treatments or dosages, and does not tell you whether something is serious.

• It is not a substitute for a veterinarian. If your cat is unwell, consult a qualified veterinary professional. If your cat may be in an emergency, contact an emergency veterinary service immediately rather than spending time in this or any app.
• It is not your clinic's medical record. Your veterinary practice keeps the authoritative clinical file. Slow Blink is your own parallel notes, and can be incomplete, out of date or mistaken in ways only you can correct.
• The Vet Brief is a summary you produced. It reflects what you entered, nothing more. It is offered as a convenience for a consultation, not as a clinical document, and a veterinarian is under no obligation to rely on it.
• Do not delay care because of what Slow Blink shows or does not show. No pattern, timeline or absence of an entry in this app should be read as reassurance.

Understanding, the educational content in Slow Blink, is general information about feline behavior and welfare. It is not advice about your particular cat and should not be treated as such.

3. Eligibility

Slow Blink is intended for a general audience and is not directed to children under 13. You may use Slow Blink only if you can legally enter into this agreement. If you are under the age of majority where you live, you may use it only with permission from a parent or legal guardian.

4. Permission to use Slow Blink

Subject to these Terms and the applicable App Store license, German Amaya grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use Slow Blink on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

Slow Blink is made for the cats in your own household. It is not licensed for use as a clinical, shelter, rescue, breeding or other professional records system, and it is not designed for that purpose.

Except as permitted by applicable law or the applicable license, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, attempt to derive source code from, or create derivative works of Slow Blink or any part of it.

5. Your archive

You retain any rights you have in the records, notes, photos, audio cues and documents you put into Slow Blink (collectively, "Your Content"). You are responsible for Your Content, including having the right to use any document or image you attach — veterinary paperwork included.

Slow Blink is a private archive. It does not publish Your Content to other users and operates no social feed. You authorize Slow Blink to process Your Content on your device and, when you enable iCloud, through Apple's services, solely to provide the app's features at your direction.

You must not use Slow Blink in a way that breaks the law, infringes another person's rights, introduces malware, interferes with the app or Apple's services, or attempts to gain unauthorized access to any account, device, network or data.

6. Apple services, iCloud and storage

Slow Blink uses Apple services including iCloud, CloudKit, the camera and photo library, the document scanner, the App Store and StoreKit. Your use of those services is subject to Apple's own terms, account requirements, service availability and privacy practices.

When iCloud is enabled and available, your archive synchronizes through the private CloudKit database associated with your Apple Account. Synchronization depends on factors outside our control, including your Apple Account status, iCloud settings, network connectivity, available storage, Apple service availability and the state of your devices.

Slow Blink stores copies of the photos and documents you add, rather than references to your photo library. Those copies consume storage on your device and in your iCloud account. Slow Blink applies limits on how many photos each cat can hold in order to keep storage reasonable; those limits may change between versions.

7. The 14-day free period

Slow Blink gives you full access for 14 days at no cost and with no payment card required. The period starts when you register your first cat, not when you install the app, so that the countdown begins when the app becomes useful to you.

This free period is administered by the app itself. It is not an App Store introductory offer and it does not create, reserve or start any subscription. Nothing is charged when it ends.

To keep it fair, the app records the start date and the most recent date it has observed in your device Keychain, which survives deleting and reinstalling the app. Reinstalling Slow Blink therefore does not grant a second free period, and moving your device clock backward does not extend or restart one. We may change the length of the free period for new users at any time; a change does not shorten a period already under way.

8. Subscriptions and purchases

Slow Blink Premium is offered as an auto-renewable subscription through the App Store. The purchase screen and Apple's confirmation show the product, price, duration and renewal terms before you complete a transaction.

• Billing: Apple charges your Apple Account once you confirm the purchase.
• Automatic renewal: a subscription renews for successive periods unless you cancel before the current period ends. The price and period are those shown at purchase and in your Apple Account settings.
• Management and cancellation: manage or cancel in your Apple Account subscription settings. Deleting the app does not cancel a subscription.
• Restore: use Restore Purchases in Slow Blink's settings after signing in with the Apple Account used for the purchase.
• Refunds: Apple handles billing and refund requests under its own policies. German Amaya cannot process refunds directly.

Availability, pricing, taxes, currency and eligibility vary by storefront and may change in accordance with Apple's rules and applicable law. We do not guarantee that every plan or offer will be available in every region at every time.

9. What happens when you do not have a subscription

When the free period ends and no subscription is active — and likewise if you cancel a subscription later — Slow Blink does not lock you out of what you have already written. This is a deliberate commitment, and we state it here so that you can hold us to it:

• Reading stays free, permanently. Every cat, chronicle, care record, episode, photo and attachment you saved remains visible and browsable.
• Generating a Vet Brief stays free. You can still produce and share a brief from the information already in your archive, including the day you need it at the clinic.
• Deleting your own data stays free. You never need a subscription to remove what is yours.
• Creating and editing require a subscription. Adding cats, new records, new episodes, new photos, and the Photo Studio, Memory Drops, sharing and Understanding features are part of Slow Blink Premium.

We may change which specific features sit on each side of that line as Slow Blink evolves, but the principle above — that your existing archive remains readable and exportable as a Vet Brief without paying — is one we intend to keep.

10. Ownership and intellectual property

Slow Blink, including its software, design, artwork, branding, illustrations, educational content and other materials provided by German Amaya, is protected by intellectual-property laws. Except for the limited right to use the app granted here and in the applicable Apple license, German Amaya and its licensors retain all rights, title and interest.

"Slow Blink" and related branding are trademarks or trade names of German Amaya. Apple, App Store, iCloud, CloudKit, Photos and StoreKit are trademarks or service marks of Apple Inc. Apple is not affiliated with or responsible for Slow Blink except as required under the applicable App Store terms.

11. Updates, availability and changes

We may update, modify, suspend or discontinue all or part of Slow Blink to maintain security, improve features, meet legal requirements or respond to changes in Apple's services. We will not intentionally use an update to remove a paid entitlement in violation of applicable law or the App Store terms.

Slow Blink and the Apple services it relies on may be unavailable, delayed or limited from time to time. We do not guarantee uninterrupted or error-free operation, continuous synchronization, or the perpetual availability of any feature.

12. Disclaimers

Slow Blink is provided on an "as is" and "as available" basis, to the maximum extent permitted by law. German Amaya disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted availability.

Without limiting Section 2, Slow Blink provides no veterinary, medical, nutritional, behavioral, legal or emergency advice, and no warranty that any information it stores or displays is accurate, complete or current. You are responsible for verifying anything that matters with a qualified professional.

Nothing in these Terms excludes or limits a warranty, remedy or consumer right that cannot lawfully be excluded or limited.

13. Limitation of liability

To the maximum extent permitted by law, German Amaya will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or records, arising from or related to Slow Blink, even if advised of the possibility of such damages.

To the maximum extent permitted by law, German Amaya's total liability for claims arising from or related to Slow Blink will not exceed the greater of (a) the amounts you paid through the App Store for Slow Blink in the 12 months before the event giving rise to the claim, or (b) US$100. This limit does not apply where applicable law prohibits it.

14. Responsibility for misuse

To the extent permitted by law, you will defend, indemnify and hold harmless German Amaya and its personnel from claims, damages, liabilities and expenses arising from Your Content, your misuse of Slow Blink, or your violation of these Terms or applicable law.

15. Apple-specific terms

German Amaya, not Apple, is responsible for providing Slow Blink support and for addressing claims relating to Slow Blink or your possession or use of it, including product-liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection or similar laws.

In the event of a third-party claim that Slow Blink or your possession and use of it infringes that party's intellectual-property rights, German Amaya, not Apple, will be responsible for investigating, defending, settling and discharging the claim to the extent required by the applicable Apple license and law.

You must comply with applicable third-party terms when using Slow Blink, including Apple's terms for iCloud, Photos and the App Store. You represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on a U.S. government list of prohibited or restricted parties.

16. Termination

You may stop using Slow Blink at any time. These Terms remain in effect until terminated. We may suspend or terminate access if you materially violate these Terms, misuse the app, create a security risk, or where required by law. Sections that by their nature should survive termination will survive, including those concerning ownership, disclaimers, limitations of liability and Apple-specific terms.

17. Governing law and consumer rights

These Terms are governed by the laws applicable to German Amaya's operation of Slow Blink, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise. Nothing here limits rights or remedies you have under mandatory consumer-protection law.

18. Changes to these Terms

We may update these Terms when Slow Blink, Apple's services, legal requirements or our practices change. The revised Terms will be posted here with an updated "Last updated" date. Where the law requires it, we will give additional notice or seek your consent before a material change takes effect.
